Date : 28.10.2024 Mr. V. Rajkhowa, learned counsel for the applicant submits that in terms of the judgment and order dated 30.04.2024, passed in WP(C) 6243/2023 and other connected cases, a direction was issued in paragraph 13 thereof that the new Board of Directors shall be constituted preferably within a period of 3 (three) months from the date of communication of the certified copy of the order.
2. It is submitted that due to reasons morefully explained in the application, the new set of Board of Directors could not be appointed within the time allowed.
3. Accordingly, by filing this interlocutory application, the applicant is seeking extension of time to comply with the order of the Court and prays for 3 (three) months (now 45 days since the application was filed on 18.09.2024) time.
4. Mr. S. Banik, learned counsel for the respondent no.1 has submitted that against the order referred above, the respondents have filed a review petition, being Review Petition No. 163/2024. He submits that the said review Page No.# 4/4
petition would become infructuous if the prayer made in this interlocutory application is allowed.
5. Accordingly, issue a notice returnable on 07.11.2024.
6. List the matter along with Review Petition No. 163/2024 on 07.11.2024.
