Heard Mr. R. Dev, learned counsel for the appellant as well as Ms. SH Borah, learned APP for the State.

This appeal under section 374(2) Cr.P.C. is directed against the judgment of conviction dated 22.08.2023 and order of quantum of sentence dated 22.08.2023 passed by the learned Additional Sessions Judge-cum-Special Judge (POCSO), Sivasagar in Special (POCSO) Case no.26/2023 arising out of Nazira PS case no.17/2023 dated 07.03.2023 under sections 376(2)(n)/376(3) IPC read with section 6 of the POCSO Act.

Appeal is admitted for hearing.

Call for the records.

Issue notice on the respondent no.2 returnable on 28.02.2024.

The learned counsel for the appellant shall take steps within 2(two) days for service of notice on the respondent no.2 by registered post with A/D. Moreover, additional process shall also be filed so as to enable the Registry to process the same and hand it over to Ms. SH Bora, learned APP for onward service of notice on the respondent no.2 thorough the jurisdictional police station and to report service.

It is submitted that Mr. R. Chakravorty, learned cousnel is no longer appearing in the matter. Hence, the Registry shall delete the name of Mr. R. Chakravorty as counsel for the appellant while listing the matter next.

List the matter on 28.02.2024.
