Heard Mr. N. D. Sarma learned counsel for the applicant and also heard Mr. P. Borthakur, learned Addl. P.P. for the State respondent No.1.
This Interlocutory Application, is filed by applicant, namely, Sri Amulya Deka for suspension of judgment and order of conviction and sentence dated 11.9.2023, passed by the learned Addl. Sessions Judge, No.1, Kamrup (M) in Crl. Appl. No.32/2022 and also judgment and order of conviction dated 16.3.2022, passed by the learned Judicial Magistrate, Ist Class, Kamrup (M) at Guwahati in G.R.Case No. 9286/2017, whereby the applicant was convicted u/s 420 IPC and sentenced him to suffer S.I. for one year and also to pay fine of Rs.10,000/- with default stipulation. It appears that the connected Criminal Revision petition has already been admitted and the record from the learned Court below has also been called for and considering the submission of learned Advocates of both the parties and also considering the facts and circumstances placed on record, the impugned judgment and order of conviction dated 11.9.2023, passed by learned Addl. Sessions Judge, No.1,Kamrup (M) in Crl.Appl. No.32/2022 and the judgment and order of conviction dated 16.3.2022, passed by the learned Judicial Magistrate, Ist Class, Kamrup (M) at Guwahati in G.R.Case No. 9286/2017 stands stayed and the applicant is allowed to remain on previous bail till disposal of the connected revision petition.
In terms of above, this I.A stands disposed of .
