                                       ORDER

29-11-2023 Heard Shri K. Gogoi, learned CGC, who has filed this application seeking review of an order dated 09.08.2023 passed by this Court in IA(C) No. 2285/2023 arising in MFA No. 62/2023.

By the said order, while staying the impugned judgment and order dated 28.04.2023 passed by the Railway Claims Tribunal, Guwahati Bench, this Court had directed deposit of the amount in the Registry of this Court within 2 (two) months. By referring to Order 27 Rule 8 A of the CPC, the learned counsel has submitted that the appellant being the Railways, it is exempted from making any such deposit under the aforesaid provision of law.

Let notice be issued, returnable by 4 (four) weeks. Ms. M. Sarma, learned counsel has already appeared for the opposite party and therefore issuance of formal notice is dispensed with. However, let a copy of this review application be served upon her by tomorrow. Since it is submitted by Ms. Sarma, the learned counsel that Vakalatnama has been filed, Cause List may reflect her name.
