Heard Ms. B. Devi, learned counsel appears on behalf of Mr. S.P. Choudhury, learned counsel for the applicant. Also heard Mr. N.J. Gogoi, learned counsel for the respondent Nos. 1 and 2.

The present application has been filed under Section 5 of the Limitation Act, 1963 for condonation of delay of 9 days in preferring the appeal against the judgment and decree dated 22.09.2017 passed by the learned Civil Judge, No. 3, Kamrup(M) in Money Suit No. 128/2010 whereby the suit was dismissed.

The ground of delay has been satisfactorily explained by the applicant and also the learned counsel for the respondent Nos. 1 and 2 has no objection Page No.# 3/3

regarding the prayer of the applicant. Considering all, the delay of 9 days in filing the connected appeal stands condoned.

The Registry shall register the connected appeal and list it in admission column.

The I/A stands disposed of.
