Heard Shri T.J. Mahanta, learned Senior Counsel for the appellant, who has
preferred this appeal against a judgment dated 16.12.2017 and decree dated
20.12.2017 passed in Title Appeal No. 01/2014 by the learned District Judge,
Jorhat whereby the appeal preferred by the present appellants against the
judgment and decree dated 23.12.2013 passed by the learned Civil Judge,
Jorhat in Title Suit No. 04/2005 has been dismissed and the judgment of the
Trial Court has been affirmed.
The present appeal is admitted on the following substantial question of law:
"4. Whether the finding of Appellate Court is bad for non compliance
of provision of Order 41, Rule 31 of the Code of Civil Procedure resulting
in miscarriage of justice."
This Court may however frame any other substantial question of law
subsequently after giving opportunity to all concerned.
