Heard Mr. M. Haloi, learned Special P.P., CBI. Also heard Mr. B.B. Gogoi, learned Additional Public Prosecutor, Assam.

This criminal revision petition is filed by the CBI challenging the judgement and order dated 19.12.2022 passed by the Principal Magistrate, Page No.# 2/2

Juvenile Justice Board, Dibrugarh in C.R. Case No.1183/2009, whereby the respondent was held not to be guilty under the alleged offence and directed to be acquitted and set at liberty forthwith.

The present application has been filed under Section 102 of the Juvenile Justice Act, 2015 read with Section 397/401 of the Cr.P.C.

Learned Special PP appearing for the petitioner submits that the relevant evidences which were adduced before the competent Court were not taken into account while passing the impugned judgment. Accordingly, the same has been challenged by filing the present petition.

Upon hearing the learned Special P.P. appearing for the petitioner, let Notice be issued to the respondent making it returnable by 4 (four) weeks. Steps on the respondent by registered post with A/D within 7 (seven) days from today.

Let the records of C.R. Case No.1183/2009 from the Court of Principal Magistrate, Juvenile Justice Board, Dibrugarh be called for.

List the matter after 4 (four) weeks.
