Heard Mr. T. Chutia, learned counsel for the petitioner. Also heard Mr. K.K. Parasar, learned Additional Public Prosecutor for the State Respondent.

Order of the Lawazima Court dated 23.08.2022 indicates that the Respondent No.2 refused to accept the notice and, as such, in view of the judgment of the Hon'ble Supreme Court in the case of N. Parameswaran Unni Vs. G. Kannan, reported in (2017) 5 SCC 737, it can be presumed that notice upon Respondent No.2 has been served duly.

In view of the above, it can be presumed that notice upon Respondent No.2 is served, but the Respondent No.2 remains unrepresented today.

Mr. Parasar, learned Additional Public Prosecutor submits that though the case diary was called for vide order dated 31.05.2022, the same has not yet been received and it is prayed for granting him more time to produce the same before this Court.

Prayer is accordingly allowed.

List the matter on 27.10.2022.
