Heard Mr. H. Das, learned counsel for the applicant/appellant.

Also heard Mr. R.C. Paul, learned counsel for Respondent No.1.

The name of Mr. S. Dutta has been shown as an advocate for the respondent in the cause list. The name of Mr. S. Dutta, learned counsel, be deleted form the cause list when the matter is listed on the next date.

The name of Mr. R.C. Paul, learned counsel be only reflected in the cause list for the respondent while the matter is listed next.

This is an application under Section 5 of the Limitation Act for condonation of delay in filing the connected MAC Appeal against the judgment and order dated 22.07.2019 passed in MAC Case no.328 of 2017 by the learned Member, MACT, Goalpara.

I have perused the application. It is found that the delay in filing the connected appeal is 31 days. The delay has been duly explained and is found to be sufficient for condonation of delay in filing the connected MAC Appeal.

Learned counsel for Respondent No.1 has also agreed to the condonation of delay.

Accordingly, the prayer for condonation of delay in filing the connected Page No.# 3/3

MAC Appeal is allowed.

The interlocutory application stands disposed of accordingly.

Registry to register the connected MAC Appeal and list the the same before this Court for appropriate orders.
