                                        ORDER

28.02.2022 Heard Mr. S. Dutta, the learned counsel for the appellant.

This Second Appeal is filed under Section 100 of the Code of Civil Procedure, 1908, against the Judgment and Decree dated 16.02.2019 passed by the learned Civil Judge, Dibrugarh in Title Appeal No. 29/2013 which is admitted on the following substantial questions of law:-

(1) Whether the appellant/defendant 2 being a bonafide purchaser under Section 41 of the Transfer of Property Act and having satisfied the mutation entry of the seller (Babua Sahu), the Appellate Court was justified to cancel the sale deed no. 1364/03?

(2) Whether the learned Appellate Court was justified to arrive at the finding that Respondents No. 1 to 7 were never served with any notice prior to conversion of annual patta to periodic patta land without discussing the fact that, the respondents no. 1 to 7 were never in possession of the suit land and hence not the original pattadars?

Any other substantial questions of law, may be formulated at the time of hearing.

LCR be called for. The appellant shall take steps on the respondents within a period of three days from today both by way of registered post with A/D and usual process.

Notice is made returnable after four weeks.
