This is an application under Section 378(3) of the Code of Criminal procedure seeking leave to appeal against the judgment and order dated 15.07.2017 passed by the learned Special Judge, CBI Court, in Special Page No.# 2/2
Case No.5/2005, acquitting the respondent herein.
Heard Ms. P.Das, learned counsel, on behalf of Mr. S.C. Keyal, learned Standing Counsel, CBI for the applicant/appellant. Also heard Mr. U.K. Barman, learned counsel for the respondent.
Considering the judgment of the case as well as agreed to by the learned counsel for the respondent Mr. Barman, the leave to appeal is granted.
The interlocutory application stands disposed of accordingly.
The petitioner shall furnish a copy of the appeal memo together with the annexures thereto to the learned counsel for the respondent during the course of the day.
