Heard Mr. B Sarma, learned counsel for the appellant and Ms. M Sarma, learned counsel for the respondent.

The connected appeal has already been admitted and at the final stage of Page No.# 2/2

hearing. In this Misc Case under order dated 28.06.2012 this court stayed the judgment impugned in the connected appeal till returnable date.

Since appeal is at the stage of hearing, this court considers that this Misc Case be disposed of making the stay absolute.

Accordingly, till the connected appeal being MFA No. 82/2011 is disposed the judgment dated 24.01.2011 passed by the learned Railway Claims Tribunal, Guwahati Bench in OA No. 224/2003 shall remain stayed.
