Heard Mr. S. C. Biswas, learned counsel for the petitioner.

By this application under Section 482 Cr.P.C., the petitioner has prayed for quashing the proceeding of CR Case No. 23/2022 pending before the court of learned Judicial Magistrate First Class, Bajali, Pathsala.

Moving the instant petition, Mr. S. C. Biswas, learned counsel for the petitioner has relied on two judgments rendered in Harmanpreet Singh Ahluwalia and others vs State of Punjab and Others reported in (2009) 7 SCC 712 and in Criminal Petition No. 626/2019 passed by the Single Bench of this Court in Kh. Sanjeev Kumar Singh Vs Smti O. Mema Devi.

Issue notice to the respondent registered A/D post within seven days.

Call for the legible scanned copy of the case record.

List the matter after four weeks.

Till the returnable date, further proceeding CR Case No. 23/2022 pending before the court of learned Judicial Magistrate First Class, Bajali, Pathsala shall remain stayed.
