Heard Mr. J Ahmed, learned counsel for the petitioners, Mr. PN Sarma, learned counsel for the respondents No. 1, 3, 4, 5, 7, 8, 9 and 10 being the authorities under the Elementary Education Department of the Government of Assam and Mr. A Chaliha, learned counsel for the respondents No. 2 and 6 being the authorities under the Finance Department of the Government of Assam.

The petitioners/predecessor-in-interest of the petitioners herein earlier served as Assistant Teachers/Hindi Teachers/Headmasters and Chowkidars respectively in their respective schools, details of which has been provided in the chart of paragraph 3 of the writ petition. The petitioners/predecessors-in- interest of the petitioners earlier instituted writ petitions before this Court claiming that they are entitled to leave encashment for earned leave up to a maximum of 300 days, being 30 days per year.

By different judgments rendered in the respective writ petitions, it was held that under the law laid down by this Court in Khagendra Nath Deka and others -vs- State of Assam and others , reported in 2011 (5) GLT 9, it had already been settled that even the employees of those establishments who have the advantage of vacations, in other words, in common parlance called as vacation departments are also entitled to a leave encashment up to a maximum of 300 days.
4. The common grievance raised in this writ petition is that in spite of having such orders in their favour, the authorities in the respondents are taking a view that the petitioners/predecessor-in-interest of the petitioners having worked in a Page No.# 7/7
vacation department would be entitled to a maximum of 10 days of earned leave per year.

The rejection of the claim of the petitioners by such stand, prima-facie appears to be incorrect and contrary to the law laid down in Khagendra Nath Deka and others -vs- State of Assam and others(Supra). More so, we also take note that there are respective judgments of this Court in case of the petitioners/predecessors-in-interest of the petitioners and therefore, it is inappropriate for the department to take a contrary stand. This attitude can also be construed to be a wilful and deliberate violation of the Court's order, which would entail a contempt proceeding against them. But taking a lenient view, we require the respondents to act in a more responsible manner and not to take any stand which is contrary to the decision of the Court. All that the respondents are required to do is to calculate as to how many days of earned leave benefits they have already availed and the balance number of days, if any, the petitioners are required to be paid. The requirements of the earlier orders are to be done as provided in such orders without any delay.
The writ petition is disposed with the above observation.
