Heard Mr. Z. Kamar, learned Sr. counsel appearing for the applicants/appellants as well as Mr. D. Das, learned Addl. P.P., Assam appearing for the State respondent No. 1.
By this interlocutory application under Section 389 (1) Cr.P.C., the applicants/appellants, who are convicted vide the impugned Judgment and Order, dated 25.09.2018, passed in Session Case No. 275/2014 by the learned Session Judge, Dibrugarh and sentenced to undergo R.I. for 2 (two) years and to pay a fine of Rs.500/- only each under Section 498(A) of the IPC and to undergo R.I. for 7 years and pay fine of Rs.500/- only each under Sections 304B/34 of the IPC and further, to pay fine of Rs.1,000/- each only in default, to undergo R.I. for 1 month have prayed for suspension of sentence and to allow them to go on bail.
On hearing the learned counsel for both sides and perusal of the impugned Judgment and Order, dated 25.09.2018, passed in Session Case No. 275/2014 by the learned Session Judge, Dibrugarh, it is provided that the operation of the sentence passed therein shall remain stayed till disposal of the connected Criminal Appeal No. 373/2018. The applicants/accused are directed to be released on bail of Rs.20,000/- (Rupees Twenty Thousand) each with one surety of like amount to the satisfaction of the learned Sessions Judge, Dibrugarh.
