06.09.2021 Shri B.D. Das, learned Senior Counsel for the APDCL submits that there is a Judgment on the same issue which he would like to place reliance upon.

On the other hand, Shri K.N. Choudhury, learned Senior Counsel submits that though the challenge is common, the grounds of challenge are different in the said writ petitions and if the decision is one of the writ petition is made to govern the present writ petition, great Page No.# 2/2

prejudice would be suffered.

Be that as it may, list this case on 20.09.2021 to enable Shri Das to place on record the said Judgment.
