By way of this application under Section 397/401 read with Section 482 CrPC, the petitioner has prayed for stay/suspension of the operation of the impugned judgment and order dated 07.09.2021 passed by the learned Sessions Judge, Nalbari in Criminal Appeal No.12/2018 till disposal of the revision petition.

Heard the learned counsel for the petitioner and also the learned counsel representing the State respondents (respondent no.1).

Petition is admitted for hearing subject to payment of 50% of the cheque amount before the learned trial court within a period of 4(four) weeks from the date of passing of this order, and withdrawal of the same is subject to the permission of the court.

Let Notice be issued to the respondent no.2 by registered post with A/D and usual process, returnable by 6(six) weeks. Extra copy of the petition be furnished to respondent no.1.

Call for the L.C.R from both the forums.

Subject to deposit of such amount pertaining to aforesaid case, further execution of the sentence shall remain suspended and the accused petitioner will remain on previous bail, till disposal of the petition.
