By way of this petition under Section 397 read with Section 401 CrPC, the petitioner has prayed for stay/suspension of the judgment and order dated 20.12.2017 passed by the learned Addl. C.J.M., Cachar, Silchar in N.I. Case No.29/2021 and subsequent judgment and order dated 23.08.2021 passed by the learned Sessions Judge, Cachar, Silchar and to remain on previous bail till disposal of the present petition.
Heard the learned counsel for the petitioner and also the learned counsel representing the State respondents (respondent no.1).
The revision petition is admitted, subject to payment of 50% of the cheque amount before the learned trial court within a period of 6(six) weeks from the date of passing of this order, with liberty to the respondent/complainant to withdraw the same after due identification.
Let Notice be issued to the respondent nos.2 to 5 by registered post with A/D and usual process, returnable by 6(six) weeks. Extra copy of the petition be furnished to respondent no.6.
Call for the L.C.R both the forums.
Subject to payment of such amount, further execution of the sentence shall remain suspended and the accused petitioner will remain on previous bail, Page No.# 4/4
till disposal of the petition.
