Heard Mr. I.A. Hazarika, learned counsel appearing for the petitioner. Also heard Mr. B.B. Gogoi, learned Addl. Public Prosecutor for the State respondent No. 2.

By this petition under Section 482 Cr.P.C., the petitioner has prayed for setting Page No.# 2/2

aside and quashing the impugned judgment and order dated 25.11.2020 passed by the learned Sessions Judge, Karimganj in criminal revision No. 1/2020 and also the judgment order dated 08.11.2019 passed by the learned CJM, Karimganj in criminal Misc case No. 246/2014.

Call for the scanned copy of the case diary along with case record in connection with criminal revision No. 1/2020 and criminal Misc case No. 246/2014.

As Mr. B.B. Gogoi, learned Addl. P.P. appears on behalf of the respondent No. 2, no formal notice need be issued to the respondent No. 2. However, extra copy of the petition shall be furnished to him within three days.

The petitioner shall take step for service of notice on the respondent No.1 by registered post with A/D and also by usual process within three days.

Arrear amount of maintenance given to the respondent No. 2 as on today shall remain stayed till the next returnable date.
