REVIEW PET. 113/2023 (for review of order dated 22.03.2023) & CM APPL. 20311/2023 (permission to file documents)

1. This review petition has been filed by the petitioner seeking review of the order dated 22.03.2023 passed by this Court in the captioned petition. The grounds sought by the petitioner seeking review of the order dated 22.03.2023 have been spelt out in paragraphs 'a' to 'dd'.

2. We have heard the petitioner at length.

3. Vide the order dated 22.02.2023, of which the review is sought, this Court had dismissed the petition by stating in paragraph no.11 as under:-

"11. The submission of the learned counsel for the petitioner is that the petitioner having been promoted to the grade of STS on January 31, 2011, his promotion should be regularized from that date. On a specific query to the learned counsel for the petitioner as to what is the eligibility period for promotion from JTS to STS, his submission is, as per Recruitment Rules, JTS must have four years regular service for being promoted to STS. If that be so, the petitioner having been promoted as JTS only on December 30, 2011, he attained the eligibility for STS only in the year 2015 and it is his own case that he has been promoted to the post of STS on regular basis on February 19, 2016. That apart, we find there is no prayer in the OA that his promotion to JTS must relate back to a date prior to 2011, so that he can get eligibility in the year 2011 for STS."

4. In effect, the case of the petitioner before the Central Administrative Tribunal (CAT), as can be seen from the prayers at page no.95-96 is for grant of JTS of ITS Group A with effect from 01.01.2003 and for regularization of his promotion as STS of ITS Group A with effect from 31.01.2011.

5. In any case, during the course of his submissions, the petitioner has stated that he is entitled to the promotion to the post of STS of ITS Group A, at least with effect from 2008.

6. During the hearing, a specific query was put to the petitioner as to any of the juniors have been regularized with effect from the date, from which the petitioner is seeking the benefits, the submissions is in the negative. In

fact, it is his submission that some of the seniors have not been given the benefits. If that be so, the attempt of the petitioner is to re-argue the case on merits.

7. We are of the view that there is no error apparent on the face of the order dated 22.03.2023 passed by this Court to review the same. Hence, the review petition is without any merits and accordingly dismissed. The pending application is also dismissed having become infructuous.
