J U D G M E N T (oral)
1. The present writ petition has been filed by the petitioner seeking directions to the respondent Nos. 2 to 4 to grant the first annual increment as SI/CD to the petitioner with effect from 01.07.2013 along with the consequential benefits arising there from by way of re-calculation of the monetary and other benefits and to extend the same relief as was granted to SI/GD Vinod Kumar by this Court in W.P. (C) 7577 of 2016 titled as SI/GD Vinod Kumar Vs. Union of India and Ors.
2. Notice issued.
3. Learned counsel for respondents accepts notice and submits that the respondents shall treat the present petition as a representation made by the petitioner seeking extending benefit of the orders/judgments passed by this Court in the cases W.P. (C) 7577/2016 titled as SI/GD Vinod Kumar Vs.
Union of India and Ors., W.P. (C) 266/2022 titled as Yogesh Kumar Saxena & Ors. vs. Union of India & Ors. and W.P. (C) 9094/2019 titled as Mahendra Singh & Ors. vs. UOI & Ors.
4. In view of above, respondents are directed to consider the case of the petitioner and if he is found identically situated with the petitioners in the aforementioned orders/judgments and if also found that there is no reason why the respondents should deny the present petition, the petitioner shall be granted the very same relief(s) as granted by this Court in the aforementioned cases.
5. Accordingly, this Court directs the respondents that they shall treat the present petition as a representation by the petitioner and extend the same relief(s) as were granted to the petitioners in W.P. (C) 7577/2016 titled as SI/GD Vinod Kumar Vs. Union of India and Ors., W.P. (C) 266/2022 titled as Yogesh Kumar Saxena & Ors. vs. Union of India & Ors. and W.P. (C) 9094/2019 titled as Mahendra Singh & Ors. vs. UOI & Ors., if the petitioner is found entitled, the respondents shall issue necessary orders within four weeks from today.
6. With the aforesaid directions, the present petition is disposed of.
7. Needless to state that if the petitioner still feels aggrieved by the order to be passed on his representation by the respondents, he may challenge the same before appropriate forum.
