1. The present petition has been filed by the petitioner praying inter alia for issuance of a writ of mandamus to the respondents Union of India/CISF directing them to pay him HRA for the period w.e.f. August, 2009 to 12.11.2009 and between 6.12.2014 to April, 2015, while serving at the CISF Unit, Amritsar Airport.

2. Counsel for the petitioner states that the issue raised in the present case stands already decided by several decisions, lastly in the case of W.P.(C) 5407/2015 entitled Avijit Das Vs. Union of India & Ors., decided on 27.5.2015 and the petitioner seeks parity with similar placed personnel, who have been granted such relief.

3. Counsel for the respondents, who appears on advance notice, states that pursuant to the judgment dated 21.8.2015 pronounced by the Division Bench in WP(C)No.7920/2015, the CISF has issued a Circular No.1/2016

dated 1.2.2016 on the subject of outliving permission without HRA and called upon all applicants to fill up the requisite form and submit it to the department for being granted HRA. A copy of the said circular is handed over by the counsel for the respondents along with the proforma, which is taken on record.

4. Counsel for the petitioner states that the petitioner shall fill up the form and submit it to the respondents and they be directed to process the same in accordance with law.

5. The petitioner shall submit the form within two weeks and the respondents shall process the same and release the HRA payable to him within four weeks from the date of receipt thereof.

6. The petition is disposed of, along with the pending applications.
