Judgement Date : 15 January, 2014
WPC NO.20080 OF 2013 05 15.01.2014
Heard learned counsel for the parties.
This writ petition has been filed challenging the inaction of the Tahasildar, Tangi, Choudwar-opposite party no.4, in not issuing the record of rights (ROR) in respect of the land measuring A.4.90 decimals, in mouza - Kochila Nuagaon, P.S. Choudwar, Dist. Cuttack, under Khata no.384, which has been subsequently changed in 1981 to Khata no.372/5 and Plot no.1069.
Learned counsel for the State, with reference to the counter affidavit, submits that in the event the petitioner approaches the Tahasildar, Tangi-Choudwar-opposite party no.4 ventilating his grievance, his case for issuance of R.O.R. may be considered.
Considering the limited nature of grievance and without expressing any opinion on the merits of the case, the writ petition is disposed of with an observation that in case the petitioner approaches the Tahasildar, Tangi Choudwar-opposite party no.4, within a period of four weeks hence along with the certified copy of this order, the said opposite party no.4 shall take steps for issue of record of rights (ROR) in respect of the land in question, in his name, as expeditiously as possible, preferably within a period of two months thereafter.
Issue urgent certified copy as per rules.
