1) By way of this petition, petitioners have sought following reliefs:-
10.1 That this Hon'ble Court may kindly be
pleased to declare the impugned appointment
order dated 18.3.2021 (Annexure P/1) so far the
appointment of private respondents on the post
of Staff Nurse/ Staff Attendant.
10.2 That this Hon'ble Court may kindly be
pleased to direct the respondent No. 4 to issue
appointment order in favour of petitioners on the
post of Staff Nurse/ Staff Attendant, in
accordance with law.
10.3 That any other relief/ order which may
deem fit and just in the facts and circumstances
of the case including award of the costs of the
petition may be given
2) Learned counsel for the petitioners submits that Director, Health
Services, State of Chhattisgarh issued an advertisement on
17.8.2020 for selection and appointment on various posts
including 151 posts of Staff Nurse/ Staff Attendant for Raipur,
Bilaspur, Sarguja and Bastar Division and according to one of the
conditions mentioned in advertisement, residents of districts falling
under Sarguja and Bastar divisions were eligible to participate in
the recruitment process. He further submits that a notification was
issued by General Administration Department, State of
Chhattisgarh on 28.5.2019 which dictates that "only local
residents of districts falling under Bastar and Sarguja Division,
shall be eligible for recruitment to the vacancies arising in class III
and class IV posts of district cadre in various departments of the
concerned districts, for a period of two years from the date of
issue of the said Notification". He contends that petitioners
participated in the recruitment process and thereafter final
selection list was published on 18.3.2021 wherein 24 outsider
candidates have been included in utter violation to the above-
stated condition mentioned in the advertisement and the
notification dated 28.5.2019. He prays to quash the selection
order pertaining to respondents No. 5 to 23. Further direction has
been sought to the State authorities to consider the names of
petitioners for appointment to the post of Staff Nurse.
3) On the other hand, learned State counsel submits that according
to Chhattisgarh Health and Family Welfare Department Non
Clerical Paramedical and Nursing (Directorate Health Services)
Class III Service Recruitment Rules, 2013 [hereinafter to be
referred as 'Rules of 2013'], the post of Staff Nurse is a Class III
post under Divisional Cadre and not a District Cadre post,
therefore, candidates from other divisions participated in said
recruitment process and this fact is evident from condition No. 4
and 5 of advertisement. He further submits that applicability of
notification dated 28.5.2019 is limited to district cadre posts only.
4) I have heard learned counsel for the parties and perused the
material available on record.
5) Admittedly, Clause-4 of the advertisement specifically states that
candidates may submit their applications for one division only.
Condition No. 5 of the advertisement expressly states that
candidate should be permanent resident of State of Chhattisgarh.
The notification dated 28.5.2019 clearly dictates that only local
residents of districts falling in Bastar and Sarguja Division shall be
eligible for vacancies arising in class III and class IV posts of
district cadre. However, Rules of 2013 make is clear that Staff
Nurse is a Class III post under Divisional Cadre and not a District
Cadre post, thus the contention made by Mr. Sahu that
respondent authorities permitted outsider candidates to participate
in examination appears to be misconceived.
6) In view of the aforesaid discussion, in my opinion, no case is
made out for interference. Consequently, this petition fails and is
hereby dismissed. No order as to cost(s).
