                          Heard on I.A. No.1/2025, application for grant of stay.


                          Mr. Patel would submit that on the date of accident, the

                    offending vehicle was is possession of respondent No.1. He has

placed reliance on the judgment passed by the Hon'ble Supreme

Court in the matter of Vaibhav Jain v. Hindustan Motors Private

Limited reported in (2025) 2 SCC 208.

Considering the submission made by Mr. Patel, I.A. No.1/2025

is allowed, subject to the appellant's depositing 60% of the awarded amount (only liability part) alongwith interest before the learned

tribunal within 60 days from today, there shall be a stay on the

remaining amount.

The claimants would be at liberty to withdraw the amount

once deposited by the appellant with the learned tribunal according

to the terms of the award.

Post the matter for final hearing.
