                                   (through video conferencing), learned counsel for the

                                   appellant in CRA No.2157 of 2023 & Mr. Avinash

                                   Chand Sahu, learned counsel for the appellant No.CRA

                                   No.2299 of 2023. Also heard Mr. Shakib Ahmad,

                                   learned Panel Lawyer for the State/Respondent.

In CRA No. 2157 of 2023 on 08/12/2023 Registry

was directed to issue notice to the father (PW-2) of the

victim/prosecutrix regarding pendency of the appeal as

well as an application for suspension of sentence and

ASHUTOSH grant of bail. The prosecutrix appeared through video MISHRA

conferencing before this Court on 08/12/2023 and

raised objections regarding grant of bail to the

appellants. Thereafter, on 21/03/2024 this Court

rejected the application for suspension of sentence and

grant of bail I.A. No.1 of 2023 and against the said

order the SLP has also been dismissed by the Hon'ble

Supreme Court.

Today the matter is listed for hearing on I.A.

No.1/2023 which is an application for suspension of

sentence and grant of bail in CRA No.2299 of 2023.

On 10/06/2024 learned AG was directed to inform the

complainant/father of the prosecutrix PW-2 regarding

pendency of the appeal as well as application for

suspension of sentence and grant of bail. However, no

one has appeared on behalf of the victim in CRA

No.2299 of 2023.

With the consent of learned counsel for the

parties, since we proceed to hear the matter finally,

therefore, the application for suspension of sentence of

grant of bail (I.A. No.1/2023) in CRA No.2299 of 2023,

stands disposed of.

Matter heard finally. Judgment has been passed

separately.
