Heard on I.A. No.1, an application for grant of interim

relief/stay.

Learned counsel for the applicants submits that vide

order dated 13.11.2019, trial Court acquitted the

applicants/accused from the charges/offence under Sections

294, 506 (II), 323, 147/149 of IPC on the ground that

prosecution has failed to prove the said charge/offence.

However, subsequently the appeal has been preferred by the

complainant/respondent and learned Appellate Court has set-

aside the order/judgment of the trial Court and remanded back

the matter for fresh trial.

Considering facts of the case, submission of counsel for

the petitioners, further the fact that applicants/accused have

been acquitted from the charges by the trial Court, purely as

an interim measure, it is directed that further proceeding of the

trial against these applicants/accused pending before CJM,

Ambikapur, Distt-Surguja, in Criminal Case No.2333/2013

shall remain stayed till the next date of hearing.

List this case on 03rd week of April 2025.
