Heard on I.A. No.2/2023, application under Section 5 of
the Limitation Act.
Counsel for the appellants would submit that counsel did
not inform the appellants about rendering the impugned
judgment and they came to know about the impugned judgment
when notice was served upon them in execution proceeding,
therefore, he submit that said delay is bonafide, hence the same
may be condoned.
Counsel for the respective respondents have raised
strong objection in respect of aforesaid application.
On due consideration and having considered the reason
mentioned in the application, I.A. No/2/2023 is allowed and the
Digitally DEEPTI signed by JHA DEEPTI NIRALA JHA NIRALA
delay of 427 days in filing the appeal is hereby condoned,
subject to depositing the cost of Rs.1,000/- by the appellants in
the account of High Court Legal Aid Committee within a period of
15 days from today.
List the matter for hearing on admission.
