4. The brief facts of the case are as under:

(a) respondents have issued an advertisement in the years 2006,

2008, 2009 for appointment on various posts of Training Officer

Class-III in various trades Computer Operator and Programming

Assistant, Cutting Tailoring, Draftsmen Civil, Mechanical, Driver

Cum Mechanic, Electrician, Electrics, Fitter, Hospital House

Keeping, Library and Information Science, Instrument Mechanic,

Mechanic Computer Hardware, Machinist, Mechanic Diesel, Motor

Vehicle, Refrigeration and Air Condition, Surveyor, Turner,

Workshop Calculation and Science/Engineer Drawing. As per the

Clause 5 of the advertisement, initially the contractual appointment

will be for one year and it may be extended, if exigency so arises

after analyzing the utility of the contractual employee by executing

the fresh contract. Clause 6 of the advertisement further provides

that their services will be governed by the Chhattisgarh Civil Sewa

(Samvida Niyukti) Niyam, 2004 (in short "Rules of 2004"). The

Rules have been framed by the State of Chhattisgarh in exercise of

power conferred under Article 309 of the Constitution of India.

(b) Rule 5 of the Rules of 2004 provides mode of appointment of

contractual appointment which reads as under:-

"5. Method of Appointment :-

(i) Declared posts of contract appointment for period declared in order under Rule 4 may be filled by Contract. Contract Appointment may be made by two ways:

(a) Contract Appointment by direct recruitment.

(b) Contract Appointment of persons are Retired from government service.

(ii) Contract appointment may be done by direct recruitment by inviting names of candidates from Employment Exchange offices of the State or by public advertisement. Contract appointment of retired persons from government services can be made through public advertisement or on the basis of his ability and suitability of particular person with concurrance of finance department."

(c) Rules 5(6) provides recruitment through publication of

advertisement, as such, the respondents in accordance with the

Samvida Niyam 2004 have issued advertisement for appointment of

Training Officer Grade-III in various trades.

(d) The Rule 6 also provides constitution of Selection Committee,

the Rule 8 provides eligibility and qualification for contractual

appointment. As per Rules 8(2) the qualification for direct

recruitment on contractual appointment shall be the same as

prescribed for the same post in Departmental Recruitment Rules.

The Rule 11 provides period of appointment which is normally for 1

year and the Department may taken a decision to extend the period

of appointment as per the necessity and obtaining feasibility of the

person appointed on contract basis. The Rule 8 of Rules of 2004

reads as under:-

"8. Eligibility and qualifications for appointment. - Eligibility and qualifications for contract appointment shall be the same as prescribed in the Rules 5 and 6 of the Chhattisgarh Civil Services (General Conditions of Service) Rules, 1961.

(a) For contract appointment by direct recruitment minimum academic qualifications and other qualifactions shall be the same as prescribed for the same post in Departmental Recruitment Rules.

(b) In case of Contract appointment of retired persons, academic qualifcations shall not be binding for appointment to equivalent post to which he was holding before his retirement."

5. It is pertinent to mention here that the respondents have not placed

Recruitment Rules on record regarding appointment of the posts for

which advertisement was issued in the years 2006, 2008 and 2009,

but has placed on record the Chhattisgarh Industrial Training (Non-

gazatted) Class-III Service Recruitment Rules, 2014 (in short "Rules

of 2014"). The Schedule-III of the said Rules provides qualification

for appointment of Training Officers on various trades. From the

clause enumerated in the advertisement regarding qualifications of

the candidates for apspointment on the post of Training Officer

Class-III on contract and as prescribed in the Schedule-8 of the

Rules of 2014 they are one and the same.

6. The Rules 8 of the said Rules provides condition of eligibility for

direct recruitment rule. The Rules 8(2) provides educational

qualification and experience. As per said Rule the candidate must

possess the educational qualification and experience prescribed for

the service as shown in Schedule-III. The Schedule-III of the Rules

of 2014 is extracted below:-

(2) The candidate should have passed National Trade Certificate from National Council for Vocational Training or State Trade Certificate from State Council for Vocational Training or National Apprentice Certificate from National Council for Vocational Training in relevant Trade, or Degree/ Diploma in Civil Engineering or equivalent branch from recognized University or Board.

(2) The candidate should have passed National Trade Certificate from National Council for Vocational Training or State Trade certificate from State Council For Vocational Training or National Apprentice Certificate from National Council for Vocational Training in relevant Trade, or Degree/Diploma in Civil engineering or equivalent branch from recognized University or Board.

(2) The candidate should have passed National Trade Certificate

7. The petitioners who are having the requisite qualification for

appointment on the regular post of Training Officer Grade-III have

participated in the selection process initiated in pursuance of the

advertisement in the years 2006, 2008 and 2009 for contract

appointment. The record of the case would show that the

respondents have allotted the marks on the basis of educational

qualification, technical qualification, CTI certificate, and imparting

education in ITI as Guest Teaching Faculty. Accordingly, they were

selected on contract basis and joined services in the years 2007,

2008, 2009 and 2010 respectively.

8. On above factual matrix, the learned counsel for the petitioners

would submit that petitioners are working since 2007, 2008, 2009

and 2010 and more than 15 years have already been lapsed and

they are having requisite qualification for appointment on the

regular post prior to date of joining of service, there is no adverse

ACR against them, therefore, they would submit that the

respondents be kindly directed to consider the case of the

petitioners for regularization. They would further submit that Hon'ble

Supreme Court in the latest judgment in case of Shripal vs. Nagar

Nigam Gaziabad reported in 2025 INC 144 passed in Civil Appeal

No. 1859 of 2024 has considered the issue and issued certain

directions for regularization of the employees who worked for more

than 10 years.

9. Per contra, learned State counsel opposing the submission would

submit that initially the petitioners were appointment on contract

basis, therefore, the employees on the contract basis cannot be

considered for regularization. The Rules of 2004 itself provides that

contractual appointment does not cast any right to the petitioners to

claim regularization, therefore, he would pray for dismissal of the

writ petitions.

10. The State has also placed on record additional facts in pursuance of

order dated 07.03.2024 passed by this Court and have informed

that in the setup of Industrial Training Institutes 2310 posts have

been sanctioned out of which 840 Training Officers are working as

regular employees and 300 Training Officers are working on

contract, thus, total 1140 posts are filled up and 1170 are lying

vacant. It has also been submitted that the State Government has

issued an advertisement for 920 posts of Training Officers for

regular appointment and out of which 280 candidates have been

appointed.

11. This Court during pendency of the petitions has directed the State

vide order dated 02.04.2024 in WP(S) No. 2533 of 2023 to examine

the case of the petitioners for regularization as they have worked

for more than 15-17 years. Accordingly, the State has constituted a

Committee and the Committee has made its report. This Court has

directed the State to place on record the recommendation of the

Committee and they have submitted an affidavit alongwith copy of

the report in WP(S) No. 2533/2023. The relevant portion of the

affidavit reads as under:-

"2. That in the instant matter vide order dated 28.02.2025, this Hon'ble Court directed the State to place on record the report submitted by the committee by way of the affidavit. The Hon'ble Court had also directed to clarify how many posts are lying vacant apart from earlier advertisement issued by the department.

3. That, in compliance of the order dated 02.04.2024, passed by this Hon'ble Court in WPS No. 2533 of 2023, Shri Sandeep Kumar Tiwari Vs. State of Chhattisgarh and Others, the State Government has constituted a committee consisting of Shri P.S. Alma, Special Secretary, Department of Skill Development & Technical Education, Shri Sunil Kumar Upadhyay, Deputy Director (Finance), Directorate of Employment & Training and Shri Ishwari Prasad Sahu, Deputy Director, Directorate of Employment & Training, to examine the case of the petitioner for the regularization. The committee has submitted its report vide letter dated 02.08.2024. The copy of the report dated 02.08.2024, is annexed herewith as ANNEXURE R/1.

4. That, from the perusal of the said report it emerges that total 302 contract employee are working as training officers in the department. That, after 2010, the department has not appointed anybody on contractual basis as Training Officer.

5. That, the committee has also considered the relevant rules which is Chhattisgarh Civil Services (Contractual Appointment) Rules, 2012 and has opined that there is no provision for regularization of the contractual employee and as per the Rule 17 of the Rules, 2012 the power of regularization can be exercised only by the General Administration Department.

6. That, since the department of Skill Development & Technical Education is not having any authority to relax the contractual appointment rule, therefore, the matter was forwarded to General Administration Department by the Skill Development & Technical Education Department. The copy of the note-sheets is annexed herewith as ANNEXURE R/2. The matter is pending consideration. before the General Administration Department at present.

7. That, vide letter dated 28.02.2025, this Hon'ble Court had directed to clarify how many post are lying vacant of Training Officer with the Department. It is humbly submitted that as on today total 589 post of Training Officer are vacant in the department regarding which no process of appointment is going on. The Copy of chart is annexed herewith as ANNEXURE R/3."

12. This report clearly spelled out that the contractual Training Officers

are working since last 15-18 years and they have also crossed the

maximum age for regular employment. It has also been mentioned

in the report that only 2 times recruitment procedure for regular

appointment of Training Officer has been conducted by the State in

the year 2010 and 2023. it has also been mentioned that all the

contractual employees have been over aged and also mentioned in

the report that keeping in this aspect of the matter, it will be

desirable that the decision may be taken at the Government level.

13. On the above factual matrix the learned State counsel would submit

that the petitioners cannot claim regularization as a matter of right,

as such, the writ petitions are not maintainable and deserve to be

dismissed.

14. I have heard learned counsel for the parties and perused the

record.

15. From the submissions made by the parties, the point emerged for

determination is that whether this Court can issue a writ of

mandamus directing the State to consider the case of the

petitioners for regularization?

16. To appreciate this point, this Court has directed the State to place

on record the availability of the vacant posts and also directed the

State to clarify whether if the case of the petitioners are directed for

consideration for regularization the ongoing selection process

issued in pursuance of advertisement for 920 posts of Training

Officers will be adversely affected or not?

17. From the bare perusal of the reports and various affidavits placed

on record before this Court, it is quite vivid that the petitioners are

working since last 15-17 years and they are having requisite

qualifications for appointment as Training Officers Class-III (Non-

gazatted) and 589 posts are lying vacant including the Training

Officers Class-III who are working on contract basis like petitioners

even after filling up of 920 posts for which advertisement has been

issued whereas number of the petitioners is 302, as such, the right

of candidates who will be selected through ongoing process

initiated on 13.05.2023 will not be adversely affected.

18. Considering the factual matrix, it is quite vivid that this Court can

issue the direction for regularization of the petitioners as they are

having the requisite qualifications, they have been recruited through

substantially complying the process of selection as they were

selected after calling candidates through publication of

advertisement, on the basis of educational and technical

qualifications, CTI certificate and imparting education in ITI as

Guest Teaching Faculty member, as such, it cannot be held that it is

a back door entry or de hors the Constitutional provisions. In such a

situation, the State deserves direction from this Court to consider

the case of the petitioners for regularization of their services.

19. The Hon'ble Supreme Court in case Secretary State of Karnataka

& Others vs. Uma Devi & Others reported in (2006) 4 SCC 1 has

considered this issue in paragraphs 53 and 54 and has held as

under:-

"53. One aspect needs to be clarified. There may be cases where irregular appointments (not illegal appointments) as explained in S. V. Narayanappall R.N. Nanjundappa and B.N. Nagarajan and referred to in para 15 above, of duly qualified persons in duly sanctioned vacant posts might have been d made and the employees have continued to work for ten years or more but without the intervention of orders of the courts or of tribunals/The question of regularisation of the services of such employees may have to be considered on merits in the light of the principles settled by this Court in the cases abovereferred to and in the light of this judgment. In that context, the Union of India, the State Governments and their instrumentalities should take e steps to regularise as a one-time measure, the services of such irregularly appointed, who have worked for ten years or more in duly sanctioned posts but not under cover of orders of the courts or of tribunals and should further ensure that regular recruitments are undertaken to fill those vacant sanctioned posts that require to be filled up, in cases where temporary employees or daily wagers are being now employed. The process must be set in motion within six months from this date. We also clarify that regularisation, if any already made, but not sub judice, need not be reopened based on this judgment, but there should be no further bypassing of the constitutional requirement and regularising or making permanent, those not duly appointed as per the constitutional scheme.

54. It is also clarified that those decisions which run counter to the principle settled in this decision, or in which directions running counter to what we have held herein, will stand denuded of their status as precedents."

20. The Hon'ble Supreme Court in case of Jaggo vs. Union of India &

Others reported in 2024 SCC Online SC 3826 has considered the

case of the employees for regularization and has passed the

following order which reads as under:-

"20. It is well established that the decision in Uma Devi (supra) does not intend to penalize employees who have rendered long years of service fulfilling ongoing and necessary functions of the State or its instrumentalities.

The said judgment sought to prevent backdoor entries and

illegal appointments that circumvent constitutional requirements. However, where appointments were not illegal but possibly "irregular," and where employees had served continuously against the backdrop of sanctioned functions for a considerable period, the need for a fair and humane resolution becomes paramount. Prolonged, continuous, and unblemished service performing tasks inherently required on a regular basis can, over the time, transform what was initially ad-hoc or temporary into a scenario demanding fair regularization. In a recent judgement of this Court in Vinod Kumar and Ors. Etc. Vs. Union of India & Ors.5, it was held that held that procedural formalities cannot be used to deny regularization of service to an employee whose appointment was termed "temporary" but has performed the same duties as performed by the regular employee over a considerable period in the capacity of the regular employee. The relevant paras of this judgement have been reproduced below:

"6. The application of the judgment in Uma Devi (supra) by the High Court does not fit squarely with the facts at hand, given the specific circumstances under which the appellants were employed and have continued their service. The reliance on procedural formalities at the outset cannot be used to perpetually deny substantive rights that have accrued over a considerable period through continuous service. Their promotion was based on a specific notification for vacancies and a subsequent circular, followed by a selection process involving written tests and interviews, which distinguishes their case from the appointments through back door entry as discussed in the case of Uma Devi (supra).

7. The judgement in the case Uma Devi (supra) also distinguished between "irregular" and "illegal"

appointments underscoring the importance of considering certain appointments [2024] 1 S.C.R. 1230 even if were not made strictly in accordance with the prescribed Rules and Procedure, cannot be said to have been made illegally if they had followed the procedures of regular appointments such as conduct of written examinations or interviews as in the present case..."

21. The High Court placed undue emphasis on the initial label of the appellants' engagements and the outsourcing decision taken after their dismissal. Courts must look beyond the surface labels and consider the realities of employment:

continuous, long-term service, indispensable duties, and absence of any mala fide or illegalities in their appointments. In that light, refusing regularization simply because their original terms did not explicitly state so, or

because an outsourcing policy was belatedly introduced, would be contrary to principles of fairness and equity.

22. The pervasive misuse of temporary employment contracts, as exemplified in this case, reflects a broader systemic issue that adversely affects workers' rights and job security. In the private sector, the rise of the gig economy has led to an increase in precarious employment arrangements, often characterized by lack of benefits, job security, and fair treatment. Such practices have been criticized for exploiting workers and undermining labour standards. Government institutions, entrusted with upholding the principles of fairness and justice, bear an even greater responsibility to avoid such exploitative employment practices. When public sector entities engage in misuse of temporary contracts, it not only mirrors the detrimental trends observed in the gig economy but also sets a concerning precedent that can erode public trust in governmental operations.

26. While the judgment in Uma Devi (supra) sought to curtail the practice of backdoor entries and ensure appointments adhered to constitutional principles, it is regrettable that its principles are often misinterpreted or misapplied to deny legitimate claims of long-serving employees. This judgment aimed to distinguish between "illegal" and "irregular" appointments. It categorically held that employees in irregular appointments, who were engaged in duly sanctioned posts and had served continuously for more than ten years, should be considered for regularization as a one-time measure. However, the laudable intent of the judgment is being subverted when institutions rely on its dicta to indiscriminately reject the claims of employees, even in cases where their appointments are not illegal, but merely lack adherence to procedural formalities. Government departments often cite the judgment in Uma Devi (supra) to argue that no vested right to regularization exists for temporary employees, overlooking the judgment's explicit acknowledgment of cases where regularization is appropriate. This selective application distorts the judgment's spirit and purpose, effectively weaponizing it against employees who have rendered indispensable services over decades. 2

27. In light of these considerations, in our opinion, it is imperative for government departments to lead by example in providing fair and stable employment. Engaging workers on a temporary basis for extended periods, especially when their roles are integral to the organization's functioning, not only contravenes international labour standards but also exposes the organization to legal challenges and undermines employee morale. By ensuring fair employment practices, government institutions can reduce the burden of unnecessary litigation, promote job security,

and uphold the principles of justice and fairness that they are meant to embody. This approach aligns with international standards and sets a positive precedent for the private sector to follow, thereby contributing to the overall betterment of labour practices in the country."

21. Again the Hon'ble Supreme Court in case of Shripal vs. Nagar

Nigam Gaziabad reported in 2025 INC 144 has considered the

case of the employees for regularization and has passed the

following order which reads as under:-

"18. The impugned order of the High Court, to the extent they confine the Appellant Workmen to future daily-wage engagement without continuity or meaningful back wages, is hereby set aside with the following directions:

I. The discontinuation of the Appellant Workmen's services, effected without compliance with Section 6E and Section 6N of the U.P. Industrial Disputes Act, 1947, is declared illegal. All orders or communications terminating their services are quashed. In consequence, the Appellant Workmen shall be treated as continuing in service from the date of their termination, for all purposes, including seniority and continuity in service.

II. The Respondent Employer shall reinstate the Appellant Workmen in their respective posts (or posts akin to the duties they previously performed) within four weeks from the date of this judgment. Their entire period of absence (from the date of termination until actual reinstatement) shall be counted for continuity of service and all consequential benefits, such as seniority and eligibility for promotions, if any.

III. Considering the length of service, the Appellant Workmen shall be entitled to 50% of the back wages from the date of their discontinuation until their actual reinstatement. The Respondent Employer shall clear the aforesaid dues within three months from the date of their reinstatement.

IV. The Respondent Employer is directed to initiate a fair and transparent process for regularizing the Appellant Workmen within six months from the date of reinstatement, duly considering the fact that they have performed perennial municipal duties akin to permanent posts. In assessing regularization, the Employer shall not impose educational or procedural criteria retroactively if such requirements were never applied to the Appellant Workmen or to similarly situated regular employees in the past. To the extent that sanctioned vacancies for such

duties exist or are required, the Respondent Employer shall expedite all necessary administrative processes to ensure these longtime employees are not indefinitely retained on daily wages contrary to statutory and equitable norms."

22. In the light of the above judgments and also considering the fact

that the posts are lying vacant, the petitioners have already worked

for more than 15-17 years and all of them must have been over

aged, appointed through following selection process which is not

dehors the Constitutional scheme, and the petitioners possess the

qualification for appointment on the regular post, I am of the view

that a writ of mandamus can be issued to the State for considering

the case of the petitioners for regularization taking into

consideration the report of the Committee and other relevant

materials as discussed above.

23. Accordingly, it is directed that the Secretary, Skill Development

Technical and Employment Department will sent a proposal to the

General Administration Department alongwith the entire material,

reports, vacancy positions, etc. within 3 months from the date of

receipt of copy of the order and obtained approval from the General

Administration Department for considering the case of the

petitioners for regularization. It is also directed that before sending

the records to the Secretary, General Administration Department,

they will examine the individual records and their qualification for

granting approval for regularization. The Secretary, General

Administration Department will grant necessary approval within

further 2 months from the date of receipt of proposal by the

respondent No. 1.

24. It is made clear that while considering the case of the petitioners for

regularization, the ongoing selection process initiated in pursuance

of the advertisement dated 13.05.2023 will not be adversely

affected. This exercise be carried out within stipulated time period

given by this Court.

25. With the aforesaid observation and direction as indicated above,

writ petitions are allowed .
