Heard on I.A.No.06/2025, for extension of temporary bail to the applicant.

By the impugned judgment dated 15.06.2023 passed by the learned First Additional Sessions Judge (F.T.C.), District Bemetara (C.G.), in Sessions Trial No. 14/2023, the appellant has been convicted under Sections 376, 376 (2)(N) and 450 of IPC & sentenced to undergo R.I. for 10 years with fine of Rs.1,000/-, R.I. for 10 years with fine of Rs.1,000/- and R.I. for 05 years with fine of Rs.500/- respectively, with default stipulation.

Learned counsel for the appellant submits that vide order dated 30.01.2025, the appellant was granted temporary bail for a period of 15 days on account of his marriage with victim, which was subsequently extended vide orders dated 12.02.2025 and 14.02.2025 as the appellant had met with an accident and at present he is undergoing treatment. Learned counsel also submits that the appellant was operated, steel rod has been inserted in his knee and he has to go for treatment regularly in every week. Therefore, the temporary bail earlier granted to the appellant may be extended for further period of one months for restoration of his injuries.

On the other hand, learned Learned State counsel vehemently opposed the bail application.

Considering the facts and circumstances of the case, particularly taking into consideration the medical condition of the appellant, I.A.No.06/2025 is allowed.

The temporary bail granted to the appellant is further extended till 17th April, 2025. The appellant shall positively surrender himself before the concerned trial Court on 17.04.2025.

List this case for final hearing before the Bench having roster.
