Heard on I.A. No. 2/2024, which is an application for substitution of legal heirs of respondents No. 1 & 3 on record as per Rule 125 of the High Court of Chhattisgarh Rules, 2007.

Learned counsel for the appellant submits that respondent No. 3/plaintiff No. 3 namely Harihar and respondent No. 1 / original defendant No. 1 - Ramdas Gond died after passing of the impugned judgment, therefore, their legal heirs have been impleaded as respondents in the instant second appeal, hence, the appellant may be permitted to contest the instant second appeal by taking them on record.

On due consideration and the submission made by counsel for the appellant, the application (I.A. No. 1/2024) is allowed. Legal heirs of deceased /respondents No. 1 & 3 may be permitted to be substituted in the memo of appeal.

Counsel for the appellant seeks time to argue on I.A. No. 01/2024, which is an application for condonation of delay in filing the appeal.

As prayed, list this case in the week after next.
