Ms. Pragya Shrivastava, Dy. G.A. for the State.

Heard on I.A. No.01/2025, application for suspension

of sentence and grant of bail to the appellant.

By the impugned judgment dated 24.01.2025 passed

by the learned 1nd Additional Session Judge, Balod District

Balod (C.G.) in Sessions Trial No.10/2024, appellants stand

convicted for the offence punishable mentioned as under:

Conviction Sentence U/s. 148, 325/149 of the R.I. for 03 years each & fine Indian Penal Code. of Rs.2,000/- each and in default of fine Additional R.I. for 06 months.

Learned counsel appearing for the appellants submits

that appellants have wrongly been convicted by the trial

Court without there being any clinching evidence available

on record against them. The appellants were on bail during

trial and did not misuse the liberty. He further submits that

the appeal will take some more time for its final

conclusion/disposal, therefore, it is prayed that the sentence

imposed upon the appellants may be suspended and they

may be released on bail.

On the other hand, learned counsel appearing for the

State opposes the same and supports the judgment of

conviction.

Heard both the parties and perused the documents

available on record.

Considering the above facts and circumstances of the

case, looking to the short sentence and also the

submissions made by both the counsel for the parties, I am

inclined to suspend the sentence and release the appellants

on bail.

Accordingly, I.A. No.01/2025, application for

suspension of sentence and grant of bail is allowed.

It is directed that the substantive jail sentence

imposed upon the appellants shall remain suspended

during the pendency of this appeal and they shall be

released on bail on furnishing their personal bonds for a

sum of Rs.10,000/- each with one solvent surety each in the

like sum to the satisfaction of the concerned Trial Court for

his appearance before the Registry of this Court on 15 th

April, 2025. He shall thereafter appear before the trial Court

on the date given by the Registry of this Court and shall

continue to appear there on all such subsequent dates as

and when given to him by the said Court till disposal of this

Appeal.

List this case for final hearing in due course.
