For Applicant : Mr. Sanjay Agrawal, Advocate
For Res./State : Mr. Jitendra Shrivastava, Government Advocate

Hon'ble Shri Justice Ravindra Kumar Agrawal
                                   Judgment on Board
06.03.2025

   1.

This is the third bail application of the applicant. Vide order dated 09.09.2024,

in MCRC No. 5946 of 2024, the first bail application has been dismissed on

merits thereafter, the applicant had moved his second bail application and

vide order dated 03.02.2025 in MCRC No. 932 of 2025, it has also been

dismissed. Hence, the third bail application.

2. Learned counsel for the applicant would submit that the seizure witnesses as

well as the memorandum witnesses have been examined and they have not

supported the case of the prosecution, the applicant is in jail since

26.06.2024 and final adjudication of the case will take its own time, therefore,

the applicant has filed this third bail application.

3. On the other hand, learned State counsel opposes the bail application and

submitted that out of total 27 witnesses, 17 witnesses have been examined

and the trial is in progress therefore, the applicant may not be released on

bail.

4. Considering the submissions made by the learned counsel for the parties

particularly considering the fact that the earlier two bail applications have

already been dismissed and also considering the fact that out of 27

witnesses, 17 witnesses have already been examined by the prosecution

and the trial is in progress, I do not find any good ground to admit this third

bail application of the applicant.

5. Accordingly, the present third bail application of the applicant is dismissed at

the motion hearing stage.
