20/06/2025 Heard Mr. Rajeev Shrivastava, Senior Advocate
along with Mr. Ashutosh Mishra, learned counsel for the
petitioner, as well as Mr. Shashank Thakur, Dy. A.G. for
the respondents.
Learned counsel for the petitioner submits that
the petitioner has been declared as "gunda" and named
in the "gunda badmash" list by impugned order dated
16.04.2025 (Annexure P-1) by Superintendent of
Police, Raigarh without affording any opportunity of
hearing to the petitioner. It is further pointed out by the
learned counsel for the petitioner that, all the cases
pending against the petitioner including the two cases
of the year 2023 are preventive in nature.
Considering the submission made by learned
counsel for the petitioner, Superintendent of Police,
Raigarh (respondent No. 4) is directed to file personal
affidavit stating whether the impugned order dated
16.04.2025 has been passed after affording opportunity
of hearing to the petitioner or not.
