Issue notice to the respondents on I.A. No.01/25,

application under Order 41 Rule 5 of the Code of Civil

Procedure, 1908 by ordinary as well as registered mode.

PF be paid within a week.

Mr. Rajeev Bharat, Govt. Advocate accepts notice

on behalf of State/respondent No.3, therefore, issuance

of notice to it is dispensed with.

List this case after service of notice.

Record of the trial Court as well as the First

Appellate Court be requisitioned.

In the meantime, purely as an interim measure, it

is directed that effect and operation of impugned

judgment & decree dated 20.12.2023 passed by First

Additional Judge to the Court of First Civil Judge, Class-

1, Korba, District Korba in Civil Suit No.16A/2017 and

upheld by Principal District Judge, Korba, District -

Korba in Civil Appeal Case No.03A/2024 shall remain

stayed till next date of hearing subject to furnishing

security of Rs.50,000/- to the satisfaction of the

concerned Court/executing Court within a period of 30

days from today for due performance of the decree

ultimately to be passed against the appellants.
