Learned Additional Advocate General for the State/Respondents
has submitted that the petition filed by the Petitioner for issuance of a writ of quo warranto itself is not maintainable. He has placed reliance upon a judgment of this Court dated 15.9.2020 passed in WPS No.2401/2020 (Naresh Chandra Gupta v. State of Chhattisgarh).
On the other hand, Learned Counsel for the Petitioner submits that the writ petition is maintainable. He has placed reliance upon a judgment passed by a Division Bench of this Court in the matter of Nitin Sinha v. Union of India, 2014 Lab. I.C. (NOC) 437 (Chh.). He has further placed reliance in the matter of Kamlesh Shukla v. State of Chhattisgarh, 2016 Lab. I.C. 1927 and also in the matter of Central Electricity Supply Utility of Odisha v. Dhobei Sahoo, AIR 2014 SC
246. List the matter on 19.2.2025 to hear the parties on the question of maintainability of this petition.
