In compliance of order dated 02.12.2024, passed by the Coordinate Bench of this Court, medical report of the appellant from Late Balriam Kashyap Memorial Government Medical College, Jagdalpur, dated 09.12.2024, has been submitted, which is also placed on record.

A perusal of the said report dated 09.12.2024 would show that it is stated by the doctor that appellant- Kamlesh Patel is suffering from major mental illness. Relevant portion of the said report is quoted herein below:

"Diagnosis: Mr. Kamlesh Patel is suffering from paranoid schizophrenia (one of the major mental illness).

Adv: He is referred to Mental Hospital, Sendri, Bilaspur for IP care."

In that view of the matter, though the present matter is listed today at motion hearing stage, but looking to the mental condition of the appellant, we deem it appropriate to decide the present appeal on merits. Hence, we proceed to do so.

Final judgment passed separately.
