Heard on I.A. No. 01 of 2024, which is an

application for grant of interim relief.

Learned counsel for the petitioner submits

that during the pendency of the application for lien

for the post of Deputy Registrar at Shadeed

Mahendra Karma Vishva Vidhalaye, Jagdalpur

Chhattisgarh, notification has been canceled, and

before cancellation of the said notification he could

not join on post of Deputy Registrar, as he was

not permitted by the respondent authorities i.e. in

an illegal and arbitrary manner. He has placed

reliance upon the judgment passed by Hon'ble

Supreme Court in the matter of State of U.P. vs.

Ram Swarup Saroj reported in 2000 (3) SCC 699,

wherein it is held that the claim of a candidate

included in the panel has not to be defeated

because currency of panel expired during

pendency of litigation when the candidate has

made representation during its validity.

Considering the aforesaid aspect of the

matter and further considering the fact that even

on the basis of said panel as decided by the

Hon'ble Supreme Court, the petitioner can be

appointed for the post of Deputy Registrar.

Looking to the aforesaid aspect of the matter

respondent No.2 is directed not to conclude any

proceeding for appointment of Deputy Registrar

during the pendency of this petition.

Accordingly, I.A. No.01 of 2024 is allowed.

Learned counsel for the State is directed to

file reply.

As prayed, list this case on 27th February,

2025.
