                       21/01/2025        None present for the appellant when the case is

                                    called out for hearing. However, Mr.Hariom Rai, learned

                                    Panel Lawyer appearing for the respondent/State, is

present.

Mr.G.V.K.Rao, learned counsel, who has been

appointed through the Legal Aid is not present to argue

the matter and the application for suspension of

sentence of the appellant is stated to be pending.

From perusal fo the records, it transpires that the

appellant is in jail since 21.03.2015 i.e. near about 10

years, hence, we requested Mr.Samir Singh, Advocate,

who is present in the Court to assist the Court. He is

agree to argue the matter. He is appointed as Amicus

Curiae.

Judgment has been passed separately.

Conviction and sentence of the appellant for offence

under Section 302 of the IPC are hereby set aside.

However, he is convicted for offence under Section 304

Part-I of the IPC and sentenced to undergo RI for ten

years.
