Heard on I.A. No. 03 which is an application for condonation of non appearance of the appellant No. 1 before the registry of this Court on 29/11/2024.

On due consideration, the I.A. No. 03 is allowed. The non appearance of the appellant No. 1 before the registry of this Court on 29/11/2024 is condoned.

When the bailable warrant was issued against the appellant vide order dated 02/07/2024, a report was submitted by the concerned Police Station dated 20/08/2024 that the appellant No. 2 Murali Lal Agrawal, S/o Shri Kanhaiya Lal Agrawal, has died on 06/06/2021 along with the report a copy of his death certificate has also been annexed.

Since, the appellant No. 2 has died and no any application has been filed by his near relative to continue with the appeal as provided under Section 394 of Cr.P.C., the appeal filed by the appellant No. 2 Murari Lal Agrawal stands abated.

With the consent of the parties, the matter has been heard finally and judgment dictated separately.
