This Court in the case of Rishikesh Sahu Vs. C.G. State Electricity Board & another has observed that in the case of electrocution, the benefit of the notification F.No.9-2-86-B-XXI dated 02-08-1986 would also extent to exempt the payment of Court fees in the appeal. This was held in FA No.63/2021 (Chhattisgarh State Power Distribution Company Ltd V/s Smt. Hemlata Netam & others).
In view of such judgment and since the death in this case is caused by electrocution, the payment of Court fees is exempted.
Accordingly, I.A. No.1/2015 is allowed.
Since this is a matter of year 2015, let paper book be filed at the behest of respondent in accordance with the High Court Rules, within a period of four weeks.
List the case for final hearing.
