This appeal is admitted on the following substantial question of law :-
"Whether finding of the lower appellate Court entitling 1/15th share to the
plaintiff - Shayara Bi even without determining the share of the
appellant/defendant No.23 - Ekbal Khan, who is also the son of one of the
daughters of said Karaamtullah S/o Abdul Rehman, namely, Shahida Begum,
is perverse ?"
Issue notice to respondents No. 1 to 20 and 22 to 26, on payment of P.F. as
per rules.
Counsel for the appellant is directed to supply the substantial question of law
as framed to the counsel appearing for the State/respondent No.21 within a period
of 15 days from today.
Also heard on I.A.No.01/2022, an application filed under Order 41 Rule 5 of
the Code of Civil Procedure, 1908 for staying the effect and operation of the
impugned judgment and decree dated 02.11.2021 passed in Civil Appeal No.1-
A/2017, pending decision of this appeal.
Issue notice of this application also to the said respondents, as above.
Meanwhile, purely as an interim measure, it is directed that the partition
proceedings in pursuance of the impugned judgment and decree dated 02.11.2021
passed in Civil Appeal No.1-A/2017 may go on, but no final order shall be passed
without prior permission of this Court, till next date of hearing.
Post this matter after 5 weeks for consideration on I.A.No.01/2022.
