Heard on IA No.2, application for modification of order dated 18.08.2022. The appellant has been convicted vide judgment of conviction and order of sentence dated 06.01.2022 passed by the learned Additional Session Judge (FTC), Kondagaon in POCSO Case No.32/2021 under Section 8 of POCSO Act and Section 366 of IPC and sentenced to undergo RI for 5 years and RI for 10 years, respectively, with default stipulations.

Vide order dated 18.08.2022, the appellant was granted bail on his furnishing a personal bond for a sum of Rs.25,000/- with one solvent surety in the like sum.

Learned counsel for the appellant submits that the appellant belongs to a poor family and he is not able to furnish a personal bond of Rs.25,000/- along with one surety. Therefore, the application may kindly be allowed and the appellant may kindly be directed to be released on bail on his furnishing only personal bond.

Considering the facts and circumstances of the case, it is directed that the execution of the substantive jail sentence imposed upon the appellant shall remain suspended and he shall be released on bail on his furnishing a personal bond of Rs.25,000/- to the satisfaction of the Trial Court for his appearance before the Registry of this Court on 01.03.2023. He shall thereafter appear before the Trial Court on a date to be given by the Registry of this Court and shall continue to appear there on all subsequent dates as are given to him by the said Court till the disposal of the present appeal.

IA No.2 stands disposed of.

List the matter for final hearing in due course.
