Heard on I.A. No.03 which is an application for extension of temporary

bail granted to the appellant.

The appellant in the instant case was granted temporary bail by this

Court on 06.02.2023 for a period of 10 days and he was required to surrender

by 20th February, 2023 at 11 a.m.. Subsequently, the present I.A. has been

filed seeking for extension temporary bail granted to the appellant.

From perusal of the records particularly the medical documents enclosed

along with the criminal appeal there does not seem to be any document which

has been produced by the appellant which could reflect that the health

condition of the appellant to be so grave or serious which would be requiring to undergo a hospitalized treatment. Moreover, from the documents it also

reflects that the majority of medical documents enclosed by the appellant are of

post conviction and that there was no strong document of medical treatment

undertaken by the appellant before the impugned judgment of conviction was

passed.

In view of the same, this Court does not find any strong case made out

for the extension of temporary bail granted by this Court. I.A. No.03, therefore,

being devoid of merits deserves to be and is accordingly rejected.

Let this matter be taken up for consideration of the application for

suspension of sentence in the week commencing 13th of March, 2023.
