Heard on Cr.M.P. followed by acquittal appeal preferred
against the judgment dated 03.01.2022 passed by the learned
Additional Sessions Judge (F.T.C.) Baikunthpur, District - Koriya
(C.G.) in Sessions Trial No. 25/2020 whereby and whereunder
learned trial Court acquitted the accused/respondents of charges
framed under Sections 304-B/34 of the IPC.
On due consideration, this Court is of the view that special leave to appeal may be granted. Consequently, the present Cr.M.P. is allowed. Registry is directed to list the matter under the head of acquittal appeal.
Record of the Court below be called. On petitioner's paying process fee within 10 days, notice along with a copy of acquittal appeal be issued to the respondents through registered and usual mode, returnable within 4 weeks.
List the matter for further hearing after service to respondents is complete and record is available along with CRA No. 1000/2022.
