Judgement Date : 21 October, 2022
HIGH COURT OF CHHATTISGARH, BILASPUR
Order Sheet
CRMP No. 1198 of 2022
Yudhesh Sandey Versus State Of Chhattisgarh
CRMP/676/2022,CRMP/1195/2022
21.10.2022 Ms. Reena Singh, counsel for the petitioners.
Ms. Madhunisha Singh, Dy.A.G. for the State / Respondent No.1.
Mr. Vijay Kumar Sahu, counsel for respondent No.2.
As prayed by learned counsel for respondent No.2, two week's time is
granted enabling him to file reply of instant petition as well as I.A. No.1/2022,
application for grant of interim relief/stay.
Heard.
Learned counsel for the petitioners would submit that respondent No.2/
complainant was under treatment for some mental issue after marriage and due
to mental issue her conduct was not appropriate. In this regard, petitioners have
sent complaint to concerned Superintendent of Police, despite that respondent
No.2/complainant has lodged the FIR implicating all the family members of
husband, including father-in-law, two brother-in-laws, mother-in-law and sister-in-
law, hence, interim protection may be granted to the petitioners. In this regard,
learned counsel for petitioners has referred judgment passed by the Hon'ble Apex
Court on 8.2.2022 in the matter of Kahkashan Kausar @ Sonam Vs. The
State of Bihar (CRA No.195/2022).
Today is the first hearing when learned counsel for respondent No.2 has
marked his presence.
In view of above, I do not feel inclined to grant interim protection to the
petitioners.
List the cases after two weeks.
