Issue notice to the Respondents on payment of P.F., as per rules.
Learned counsel for the Petitioner would submit that pursuant to the earlier decree
passed by Rent Control Authority, the Petitioner was put into possession, who is the
landlord. Subsequently, the said judgment having been subject of appeal, the Rent Control
Tribunal vide its order dated 17.03.2022 has reversed the finding of the Rent Control
Authority. He would submit further that the Petitioner has taken the possession of the
premises and on the basis of the reversal of the order, if the possession is again
transferred to Respondent it would have adverse effect inasmuch as the order of the
learned Rent Control Tribunal is perverse.
Having considered both the judgment passed by Rent Control Authority as well as
Rent Control Tribunal and also considering the fact that the Petitioner was put into
possession of the suit house, it is directed that the status quo, as it exists today, in respect
of the possession of the property shall be maintained till the next date of hearing.
