1. On earlier occasion ie.., on 29-4-2022 when the case was called for hearing none appeared on behalf of the appellant nor any representation was made on his behalf, therefore, this Court vide its order dated 29-4-2022 issued a fixed date SPC to the appellant and in pursuance thereof, bailiff's report has been received wherein it has been stated that the appellant died on 3- 12-2020 and the daughter of the appellant has received the notice, therefore, it is returned with endorsement that the appellant has expired. It further shows that the notice has been served on 7-6-2022. Despite service of notice, no one has appeared on behalf of the appellant and legal representatives of the deceased appellant have also not filed any application before this court to prosecute the present appeal.

2. In view of the above, this court has no other option except to dismiss the appeal.

3. Accordingly, the instant second appeal is dismissed for want of

prosecution. Sd/-
