1) This appeal is filed under Section 374(2) of Code of Criminal Procedure, 1973 against the judgment of conviction and order of sentence dated 20/11/2012 passed by Special Judge (Electricity Act, 2003) Raigarh, District Raigarh (C.G.) in Special Case No. 896/2009; whereby the appellant stands convicted and sentenced as under:-

Conviction Sentence Under Section 135 of R.I. for four months and three times of the Electricity Act, financial loss of Rs. 6,900/- i.e. Rs. 2003 20,700/-, in default of payment of fine additional R.I. for one month.

Under Section 154(05) of the Electricity Act amount of Rs. 13,800/- is liable to be recovered as civil liability for the energy loss.

2) In compliance of order dated 29/04/2022 of this Court, Ms. Binu Sharma, Panal Lawyer has verified and the reported that the sole appellant has died on 13/02/2017. Copy of the Death

Certificate as well as the certificate of the Sarpanch, Gram Panchayat, Khodapali, Janpad Panchayat Dharamjaigarh (C.G.) is also available on record confirming the fact that the appellant died on 13/02/2017.

3) No application has been filed by the legal heirs of the appellant for prosecuting this appeal till date.

4) In these circumstances, the present appeal stands abated and is dismissed as such.
