Mr. Ravindra Sharma, learned counsel for the proposed respondents submits that initially plaintiff filed a suit for partition before the trial Court in the year 2013. Some of the suit property has been purchased by applicant/proposed respondent Hemant Kumar Sahu vide sale deed dated 06.06.2007 and some of the suit property has been purchased by applicant/proposed respondent Puran Singh vide sale deed dated 11.02.2008. Photocopies of the sale deeds are annexed with the applications submitted by them.
On perusal of the judgment of the trial Court, it also appears that trial Court has dismissed the suit for non joinder of the necessary parties.
Learned counsel for respondent No.1 opposes both the applications. Looking to the above and for the reasons mentioned in the applications, both the applications are allowed.
Necessary amendment may be incorporated within one week. List the matter in the week after next for admission.
